Anna G. Coaching – Terms and Conditions
1. Applicability
These terms and conditions apply to all appointments, relationships, or activities performed by Anna G. Coaching, including those involving any coach representing Anna G. Coaching, whether paid or unpaid.
2. Coaching Services
a. Coaching is a collaborative project between the Coach, Anna G. or any coach representing Anna G. Coaching and the Client. It involves a thought-provoking and creative process to inspire clients to maximise their personal and professional potential.
b. Some coaching services may be paid for or sponsored by an Employer. Such sponsorship shall not impact the confidentiality of coaching sessions.
3. Client Responsibility
The Client acknowledges and agrees that they are responsible for creating, maintaining, and implementing their physical, mental, and emotional well-being, decisions, actions, and results in all areas of their life. Coaching is not therapy and does not substitute for treatment. It does not prevent, cure, or treat any mental disorder or medical condition.
4. Professional Advice
The Client understands that Coaching is not a substitute for legal, medical, financial, business, or other qualified professional advice. All decisions are exclusively the Client’s responsibility.
5. Confidentiality
a. In sponsorship cases, confidentiality between the Client and Coach shall remain unaffected, and the content of coaching sessions shall not be disclosed to the Sponsor. This coaching relationship is bound by strict confidentiality under the International Coaching Federation Code of Ethics.
b. The Coach agrees not to disclose any information about the Client without the Client’s written consent. Confidential information does not include information that (a) was in the Coach’s possession before being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party without breaching any obligation to the Client; (d) is independently developed by the Coach without reference to the Client’s confidential information; or (e) is required by law to be disclosed.
6. Non-Disclosure Agreement
The Client and Sponsor agree to maintain strict confidentiality regarding any information, business methods, policies, procedures, techniques, research, trade secrets, or other knowledge acquired during the coaching relationship.
7. Ethical Sharing
a. Topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, further coaching professional development, and consultation purposes in accordance with coaching ethics.
b. Unresolved ethical situations may lead to the dissolution of the coaching relationship at the discretion of the Coach (e.g., illegal activity by the Client or conflicts of interest).
8. Data Protection
The Coach will protect all confidential Client data with the same degree of care as their own. The Coach is not responsible for data disclosure or breaches through third parties’ hacking, theft, or other illegal activities.
9. Termination
The Client or the Coach may terminate this Agreement with two (2) weeks’ written notice. Unused coaching fees will not be refunded if the Client terminates the Agreement. If the Coach terminates the Agreement, any unused sessions will be refunded.
10. Limited Liability
Except as expressly provided in this Agreement, the Coach makes no guarantees or warranties, express or implied. The Coach will not be liable to the Client for consequential or special damages. The Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Coach for all services rendered until the termination date.
11. Non-Refundable Payments
All payments are non-refundable.
12. Governing Law and Jurisdiction
This Agreement is governed by Dutch law, and the courts of Amsterdam shall have exclusive jurisdiction over any dispute arising under this Agreement.
13. Dispute Resolution
In case of a dispute that cannot be resolved by mutual consent, the Client and Coach agree to attempt mediation in good faith for up to 30 days after notice is given. The parties agree to formal mediation under Dutch law if the dispute is not resolved through mediation.
14. Severability
If any provision of this Agreement is ineffective, either in whole or in part, it will not affect the validity of the remaining provisions.
